Hearing dates set for Bay Beach appeal

The Ontario Municipal Board (OMB) appeal of the Bay Beach development project will be heard starting on Nov.1 and may last as long as three weeks.

A pre-hearing was held this morning at Fort Erie Town Hall with Harold Goldkind, the presiding member of the OMB. For more information about pre-hearings, see this OMB publication.

The meeting was very short as the lawyer for the Fort Erie Waterfront Preservation Association, Eric Gillespie, had been unable to consult with his large number of clients to determine the specifics of the appeal.

“We haven’t been able to settle the issues yet,” said the Town’s lawyer for the hearing, Lyn Townsend of Townsend and Associates.

She suggested a telephone conference be held on Aug. 19 with a board member and the appellant where the issues can be fully identified and other matters in advance of the hearing can also be settled.

The presiding member concurred.
