Cop cleared in SUV/bike collision

A Niagara Regional Police officer has been cleared of criminal liability in  a collision with a bicycle at the Friendship Trail on Point Abino Road last August.

The Ontario Special Investigations Unit said the cyclist likely did not come to a stop and look before crossing the road and was hit by a south-bound police SUV driven by an officer who is unidentified.

SIU director Ian Scott said the investigation showed that the officer was not speeding.

Five officers and three civilians were interviewed for the investigation. The subject officer declined to be interviewed.

James Rawthorne, 50, suffered serious injuries in the collision in the early afternoon of Aug. 29 and was airlifted to Hamilton General Hospital. His current condition is not known.

“I have no grounds to believe that the subject officer is in any way responsible for this collision,” said Scott.

“The bicycle trail has clearly marked stop signs as one approaches the crossing of Point Abino Rd. While there are ‘pedestrian warning’ signs along Point Abino Rd, there are no stop signs for motor vehicles at the crossing.”
